Judge dismisses Boise Tower Associates’ suit

Ada County District Court Judge Darla Williamson has dismissed a lawsuit filed by Boise Tower Associates LLC against the city of Boise and the Capital City Development Corp. on Nov. 2, 2004, the city announced April 29.

Boise Tower Associates, a development firm headed by Rick Peterson, had alleged that the revocation of its building permit caused the financing failure of its proposed development at Eighth and Main streets in downtown Boise.

In addition to dismissing the case, Judge Williamson entered judgment against Boise Tower Associates to pay $68,424.35 in attorney’s fees and court costs to the city.

The district court originally filed summary judgment in the city’s favor on May 10, 2007. Boise Tower appealed the case to the Idaho Supreme Court, which affirmed the lower court’s ruling and remanded it back to district court to decide other issues, including the attorney’s fees that had not been addressed previously. Today’s ruling marks the conclusion of the case.
