What makes a good lobbyist?

The best lobbyists provide accurate information, respect government processes and avoid pie-in-the-sky promises, several Idaho lobbyists and paid advocates said.
Lobbyists represent the interests of their employers or private clients in government policymaking arenas. In Idaho, they are registered with the Secretary of State’s Office.
Scott Peyron served as press secretary for Idaho Gov. Cecil Andrus from 1990 to ’95, then launched Scott Peyron & Associates in ‘96. The downtown Boise firm employs nine including another former governor’s press secretary and two former corporate communications vice presidents of Fortune 500 companies.
“‘Good lobbyist’ is not an oxymoron,” Peyron said. “There are many capable advocates in state capitals and in Washington, D.C., who have the ability to think strategically, not just expediently, for their client and then know the material well enough that they can advocate persuasively in formal and informal settings that are constants of the political ecosystem.
“As Gov. Andrus showed us so well, a good sense of humor and the ability to make friends across the aisle are crucial parts of the mix,” Peyron said. “Here’s to those who are serious professionals but don’t take themselves too seriously.”
Mike Tracy owns TracyCommunications Inc. in Boise.
“As a longtime veteran of both (U.S.) Sen. Larry Craig’s office and the Idaho Farm Bureau, I’ve had the opportunity to observe some of the best lobbyists in the state,” he said. “Two of the keys to their success are delivering good, accurate information about an issue, and it must be in a timely fashion.
“Legislators at both the state and federal level do not appreciate getting faulty data, analysis or information from lobbyists,” Tracy said. “The lobbyists that have both success and longevity in Idaho are the ones who always deliver consistently in these two areas.”
Jeremy Pisca, an attorney at the Evans Keane law firm in Boise, does government-affairs work for clients.
“A good lobbyist is someone who can influence decisions with honesty and integrity,” he said. “Particularly in a small state like Idaho, a lobbyist’s reputation is his stock.
“Elected officials have to be able to trust and rely on the information you give them,” Pisca said. “If a lobbyist gets a reputation as untrustworthy, anything they try to do will be met with skepticism. Word spreads quickly.”
A good lobbyist also respects the fact that an elected official has a constituency, he said.
“I respect anyone that has ever stuck their neck out and run for office – whether I agree with their point of view or not,” Pisca said. “I understand that the elected official I’m trying to convince will have to answer to his or her constituency. A good lobbyist will give a legislator the good, the bad and the ugly and explain why the good outweighs the bad and the ugly.”
Attorney Teresa Molitor joined the Elam & Burke law firm in Boise in September. Previously she worked for three years as a lobbyist for the Idaho Association of Commerce & Industry, where she specialized in human resources and education issues.
Moving from an association to a law firm provided potential opportunities to work for new clients on new issues, she said.
“But whether for an association or a client, you want to do the best job,” Molitor said.
Respect for government processes remains key for successful lobbyists, regardless of who they represent, she said. “The issues might change, but the process is something that guides all of us.”
At the Givens Pursley law firm in Boise, attorney Ken McClure does government-affairs work for clients. He has been doing it in Idaho for more than two decades.
McClure’s clients include the Idaho Medical Association, Idaho Society of CPAs, individuals and small businesses, and big corporations including Anheuser Busch, General Motors and 3M. Some clients have one-time needs, but most need ongoing services, he said.
“I don’t do much federal stuff,” he said. “My view is, that is either something you do or don’t do, and I don’t do it.”
McClure’s career includes stints as chief of the Legislative and Administrative Affairs Division of the Idaho Attorney General’s Office (1981-84) and as a deputy attorney general for the state Tax Commission (1980-81).
In successful lobbying, “first and foremost is honesty and integrity, and reliability of information,” he said. “One of the things lobbyists do most is provide information for people who need it. If that information is either incomplete or inaccurate, the information is not worth very much.”
Using reliable information, the effective lobbyist can tell legislators that one approach would produce one result, and another approach would lead to another outcome, McClure said.
“If the fact is that it wouldn’t cause that result, I have not helped the legislative body with its decision and, in fact, have harmed the client because I have undercut my own credibility,” he said.
Respect for government processes is key to a lobbyist’s success regardless of the policymaking outcome, McClure said.
The legislator’s job to represent his or her constituents’ best interest may not fit with the interests of a lobbyist’s client on a particular issue, McClure said.
“It will not always be in the legislator’s interest to do what is in my client’s best interest, and I need to respect that distinction,” he said.
Good lobbyists don’t threaten anyone, and they don’t waste a person’s time, McClure said.
“And you absolutely never link public policy issues and campaign contributions,” he said.
Another no-no is getting paid based on the outcome of a lobbying outcome.
“Unlike traditional law where contingent fees are legal in most circumstances, they are not legal in this practice,” McClure said.
“Some people believe that a lobbyist’s job is to win at all costs,” he said. “I don’t believe that. My job is to do my best for the client, and hope that I am able to present the information in the most sympathetic light, and that the information will be most useful for the decision makers.”
Understanding the context in which issues are raised helps lobbyists and their clients, McClure said. Part of successful lobbying involves counseling the client on which expectations are reasonable, and which aren’t, he said.
“Help formulate a strategy to maximize the ability to achieve the objective,” he said. Instead of just agreeing to do something that the client wants, a good strategy often is to identify problems avoided if a particular approach is used, McClure said.
“Giving the client a reality check is an important thing,” he said. “That doesn’t mean I’m always right.”
